Website Terms

Your agreement for using our website and online services

Website Access

  • We grant you a non-exclusive, non-transferable, revocable license to access and use our website for personal, non-commercial purposes
  • You must not access or use the website for any illegal or unauthorized purpose
  • We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion
  • You are responsible for maintaining the confidentiality of your account information

Service Terms

Terms and conditions for our bathroom remodeling services

Service Agreement

  • Our services are provided to individuals aged 18 and over who can form legally binding contracts
  • All estimates and quotes are valid for 30 days from the date of issuance
  • Written contracts must be signed before work begins
  • We reserve the right to decline any project or client
  • Client must provide safe and legal access to the work site

Estimates and Quotes

  • Initial estimates are based on information provided and may change after site assessment
  • Final quotes are fixed-price and include all materials, labor, permits, and cleanup
  • Changes requested by the client may result in additional charges
  • All pricing is in U.S. dollars

Payment Terms

  • 30% deposit required to begin work
  • 40% payment due at start of installation phase
  • Final 30% payment due upon completion
  • We accept cash, check, credit cards, and financing options
  • Payments are non-refundable except as required by law
  • Interest of 1.5% per month will be charged on overdue accounts

Project Changes

  • Changes requested after contract signing may affect timeline and cost
  • Any changes will be documented in writing with updated pricing
  • We are not responsible for delays caused by client-requested changes
  • Force majeure events may cause delays without liability

Warranties and Limitations

Our commitments and limitations of liability

Our Warranties

  • We warrant all labor and workmanship for 2 years from the date of completion
  • All materials and fixtures are covered by manufacturer warranties
  • We will repair or replace any defective work at our discretion
  • Our waterproofing systems are protected against leaks for 2 years
  • We use only qualified and insured subcontractors

What's Not Covered

  • Normal wear and tear
  • Damage caused by improper maintenance or misuse
  • Changes to the work by others after completion
  • Pre-existing conditions not disclosed during assessment
  • Acts of God or natural disasters

Limitation of Liability

  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability will not exceed the amount paid for the services
  • We are not responsible for delays caused by weather, material availability, or client decisions
  • We are not liable for damage to property not caused by our negligence
  • All claims must be made in writing within 30 days of discovery

Dispute Resolution

  • Disputes will be resolved through mediation in Providence County, RI
  • If mediation fails, disputes will be resolved in Rhode Island courts
  • Client is responsible for all legal fees if we prevail in litigation
  • Small claims court may be used for claims under $5,000

Client Responsibilities

Your obligations during the remodeling process

Pre-Construction

  • Provide accurate information about your property and requirements
  • Make timely decisions about materials and design choices
  • Secure necessary permits if required by your homeowner's association
  • Provide clear access to the work area
  • Remove personal items from the work area

During Construction

  • Keep the work area clear of personal items
  • Follow safety instructions and site rules
  • Make payments according to the agreed schedule
  • Communicate promptly about any concerns or changes
  • Provide access to water and electricity as needed

Material and Design

  • Client is responsible for all material selections and color choices
  • We are not liable for color variations in natural materials
  • Substitutions may be made for unavailable materials with client approval
  • Final design decisions must be made before construction begins
  • Client must approve all material deliveries

Post-Construction

  • Inspect work thoroughly before final payment
  • Report any issues within the warranty period
  • Maintain the work according to our care instructions
  • Keep all warranty documents and receipts
  • Provide feedback and reviews as requested

Termination

Circumstances under which agreements may be terminated

By RicarBathPlan

  • Client fails to make payments when due
  • Client does not provide access to the work site
  • Client interferes with our work or creates safety hazards
  • Client provides false or misleading information
  • Client violates any terms of this agreement

If we terminate for client default, all payments made are non-refundable and client is responsible for all work completed.

By Client

  • Client may terminate for our material breach with 7 days written notice
  • Termination without cause requires 50% of contract price as liquidated damages
  • Client is responsible for all work completed and materials ordered
  • We will not be liable for any costs associated with finding a replacement contractor

Termination for convenience requires written notice and payment for all completed work and non-returnable materials.

Governing Law

Legal framework and jurisdiction for our agreements

Legal Framework

  • These terms are governed by the laws of the State of Rhode Island
  • Any disputes will be resolved in Providence County, RI courts
  • These terms constitute the entire agreement between parties
  • We may update these terms at any time; continued use constitutes acceptance
  • If any provision is found invalid, the remaining provisions remain in effect

Indemnification

  • Client agrees to indemnify and hold us harmless from any claims arising from client's actions
  • Client is responsible for any damage to adjacent properties caused by their actions
  • We are not liable for injuries to client or their guests during construction

Insurance and Permits

  • We maintain general liability and workers' compensation insurance
  • Client is responsible for maintaining homeowner's insurance during construction
  • We will obtain all necessary building permits for the work
  • Client is responsible for any permits required by homeowner associations
  • We are not responsible for delays caused by permit approval processes

Force Majeure

  • We are not liable for delays or failures due to events beyond our control
  • This includes but is not limited to: weather, natural disasters, strikes, material shortages
  • We will notify clients promptly of any force majeure events
  • Projects will be rescheduled as soon as reasonably possible
